1. Agreement
These Terms govern access to AI ADSER, provided by BSYKA MOMO INC. By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you use the Service for an organization, you represent that you have authority to bind it.
2. Eligibility and authorized use
You must be legally capable of entering a contract and authorized to manage every advertising account, Page, Pixel, website, and business asset you connect. You may use the Service only for lawful business purposes and in compliance with Meta's terms, advertising standards, developer policies, and applicable law.
3. License and devices
Subject to payment and compliance, we grant a limited, revocable, non-exclusive, non-transferable license to use the desktop software on authorized devices. License keys, device access, administrative credentials, and user accounts may not be sold, shared, bypassed, reverse engineered, or used to evade technical restrictions.
4. User responsibilities
You are responsible for account security, the accuracy and legality of advertising content, targeting, claims, offers, budgets, landing pages, tracking, privacy notices, consent mechanisms, and all actions submitted through your connected accounts. You must review plans and preflight information before publishing.
5. Prohibited conduct
You may not use the Service for fraud, deception, discrimination, unlawful surveillance, credential theft, malicious code, platform abuse, rights infringement, unauthorized account access, prohibited products, circumvention of platform review or enforcement, or any activity that harms users, BSYKA MOMO INC., Meta, or third parties.
6. Third-party platforms
Meta and other third-party services are independent. Their availability, permissions, APIs, policies, reviews, delivery systems, and enforcement decisions are outside our control. AI ADSER is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc.
7. Fees, suspension, and termination
Applicable fees and billing terms are provided at purchase or in a separate order. We may suspend or terminate access for nonpayment, security risk, misuse, legal requirements, policy violations, or material breach. Upon termination, you must stop using the software. Sections intended by their nature to survive will remain effective.
8. Intellectual property
The Service, software, design, documentation, and related intellectual property belong to BSYKA MOMO INC. or its licensors. You retain rights to content you provide and grant us only the rights reasonably required to operate and support the Service.
9. No performance guarantee
Advertising and AI-generated recommendations involve uncertainty. We do not guarantee approval, delivery, reach, conversions, revenue, profitability, account status, or any advertising result. Recommendations require professional judgment and user review.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or error-free results.
11. Limitation of liability
To the maximum extent permitted by law, BSYKA MOMO INC. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, advertising spend, account restrictions, or third-party platform actions. Any aggregate liability will not exceed amounts paid for the Service during the twelve months preceding the event giving rise to the claim.
12. Indemnification
You agree to defend and indemnify BSYKA MOMO INC. from claims arising from your content, advertising, connected assets, violation of law or third-party terms, or breach of these Terms, to the extent permitted by law.
13. Governing law
These Terms are governed by the laws applicable in the State of Ohio, United States, without regard to conflict-of-law principles, except where mandatory consumer law provides otherwise.
